Ms. Lindgren, a partner with the firm since its inception,
is a litigator and trial lawyer specializing in complex financial
litigation. She has handled numerous cases involving complicated
contractual disputes, energy issues, securities fraud, accounting
malpractice, and real estate transactions in both state and
federal courts.
Ms. Lindgren’s practice includes representation of individual
and corporate clients, including financial institutions, energy
companies, real estate developers and other national and international
institutions. She handles energy matters involving both contractual
and regulatory issues. Many of her other cases involve multi-layered
securities and derivative structures, or complicated accounting
issues. Typical representations and matters include those
below.
Ms. Lindgren has represented Sempra Energy for many years
in a variety of matters related to energy and energy contracts.
She represented Sempra Energy in a dispute with Occidental
Petroleum related to an agreement to construct and operate
a power plant, which resulted in an arbitration award in favor
of Sempra Energy on every issue. She also represented Sempra
Energy in an arbitration proceeding brought by the California
Department of Water Resources related to a long-term energy
contract. The arbitration award rejected the Department’s
request to rescind the contract and ruled in favor of Sempra
Energy on the most significant contractual interpretation
disputes.
Ms. Lindgren and other members of the firm represented Rabobank
in an action against Royal Bank of Canada arising from Enron-related
transactions, which resulted in a confidential settlement
prior to trial. She had a major role in the firm’s representation
of Orange County in numerous suits against investment firms
and other advisors following its bankruptcy, which resulted
in recovery of over $800 million in investment losses. She
has also represented other investors in numerous lawsuits
involving securities fraud, disputed financial investments
or partnership interests.
Ms .Lindgren represented Community West Bancshares and Goleta
National Bank in an accounting malpractice matter against
a major accounting firm related to loan securitizations, and
has handled numerous other accounting malpractice matters
on both the plaintiff and defense side. She also represents
clients in tax shelter litigation against KPMG LLP and others.
Ms.Lindgren has also handled appeals and appellate arguments
in the Ninth Circuit Court of Appeals and California Court
of Appeal.
