Bankruptcy Transactions and Financing

In addition to restructuring balance sheets and operations, bankruptcy also presents an opportunity to divest a company of businesses and lines of business.  HBD has experience both in the selling and the buying of assets of distressed companies.  We have guided debtors through structuring and completing sale processes of individual assets, lines of business, and their entire operations, and we have advised buyers in acquiring assets and businesses including, among other things, offering strategic advice, documenting the transaction, obtaining court approval, and closing the transaction

Sale transactions and the operating in chapter 11 invariably require additional capital.  HBD has advised clients on obtaining debtor-in-possession financing to fund operations pending a sale or confirmation of a plan of reorganization, exit financing to fund distributions to creditors under a plan of reorganization, and financing to facilitate the acquisition of an asset or business, either through a plan of reorganization or on a stand alone basis.  Our efforts have included negotiating, documenting, obtaining approval of, and closing these transactions.
